    Ive been ocntacted by someone that sells jewellery that has a similarish name as mine.
    A pals looking into it for me, may have to change my name.

      Apparently they are very established, but its not even the same name which annoys me.
      Thank goodness I havnt had a load of stationery made up with my name on.Itl just be a rubber stamp down the drain.

          Ive pm'd you, as I dont want to give them any advertising.

          Im not too bothered about the name other than someone telling me I have to cease and desist!!!
          Its just waste of a rubber stamp and I had such hassle on settling on that name anyway.
          Wonder how much its going to cost me to change!

              Well, thats what i think but dont want to get into trouble tho.
              She is probably worried about the competion form me, especially as Iv just sold another necklace!!!!

                    If it's the one in NYC she says she's been running since 2000. The name is similar but unless she has it copyrighted I don't think you have a problem. She is in the US so maybe difrent rules.

                        If all she's done is write to you to "cease and desist" then I'd just reply with a "thank you for your standard scary letter".

                        If she felt there was any way she could win, she'd be threatening lawyers and all sorts, but you are based in the UK and therefore governed by UK laws.

                        Ignore her, and stick to your guns.

                        Oh, and there's nothing the IR can do about it.

                          Trademarks are the only thing to worry about e.g. ipod etc..

                          no trademarks let alone internation one..

                          A great example of this is gmail...

                          google lost both german case and the uk case for gmail even with $millions ..

                          Hence in the uk its called googlemail ...

                            Thanks for your replies everyone.

                            Ive reread the email and Im more relaxed about it.As you say MJ she merely suggested to cease and desist not 'Im phoning my lawyers now'.

                            Ive been writing a list of reasons why i neednt change my name, the main one being that the word JEWELLERY is the selling point which I actually put in my title and she didnt.
                            Also Id like to know how she paid copyright fees to the Brothers Grimm.

                              As far as I'm aware, you can be could be called exactly the same and both sell jewellery, as long as you don't claim to be her or try to pass your work off as her, then it's perfectly legal. I'm sure there is a thread about this on here someplace else.

                              How many 'Sparklez/s' do you think there are? Doesn't bother me in the slightest and I wouldn't let it bother you, especially as you've said the names aren't the same.

                              If you are worried about it, you could look into registering your company name, but it's expensive and not worth it IMHO.
